Employment Standards Board

The Employment Standards Board is responsible for administering certain provisions under the Employment Standards Act.

What is the function of the board?

The primary role of the Employment Standards Board is to, in accordance with the Employment Standards Act, exercise the powers conferred on it by the Act, including:

  • adjudicate appeals of employers / employees regarding orders issued by the Chief Employment Standards Officer; and
  • annually review the Minimum Wage Order and recommend accordingly to the Lieutenant Governor in Council.

Primary Role: Adjudicative

Material Role: Advisory 

How many people are on the board?

The board shall consist of not less than six persons equally representative of employees and employers respectively, and one additional person who shall be chairperson. There may also be appointed one or more vice-chairpersons. Employer and worker representatives, as well as the chair and vice-chair, are appointed from among individuals who apply through Engage PEI.

What are the requirements of the board members?

Mediation and tribunal skills.

What are the nomination requirements?

Statutory Nomination Requirements
The Lieutenant Governor in Council shall appoint all members.

Will I get paid?

Chair - $200/diem and Members - $142/diem.

What is the time commitment of the board?

Quarterly meetings of the board, plus attendance at hearings when appointed to a panel. Hearings and meetings of the Employment Standards Board occur during business hours. Typical time commitments vary, as noted below:

  • chairperson may be needed 11 to 38 days;
  • vice chair 6 to 9 days;
  • members 3 to 5 days per year.

Members of the board shall be appointed for a term not to exceed three years and are eligible for re-appointment.
